  • Ensure that there is no seizure, mortgage, or confiscation of the property:

The tax number in Turkey is a number allocated by the Turkish government to every foreign person residing in Turkey, through which many financial transactions are controlled, with regard to legal and official matters of the property.

Note that the issuance of the number does not require the presence of an official residence in Turkey, it is granted based on a passport number, with a copy of the passport translation and certified by a notary. It is extracted by visiting the tax department in any Turkish city.

  • Payment of title deed or title deed fees at the Land Registry Department:

The title deed expenses are calculated on the basis of calculating a percentage imposed by the Turkish government at 4% of the property price, and are paid in half between the seller and the buyer.

Types of Tabu (title deed) in Turkey:

Red title deed: It is issued from the purchase of (apartment, villa, office, land included in the organization)

Blue title deed: It is the title deed for agricultural land used for agriculture or poultry breeding.

In addition to several types of title deeds, namely:

  • Real estate easement deed: This type is based on the division and planning of the building, after obtaining the construction approval from the municipality.
  • Floor easement deed: It is a paper obtained to clarify information about the rights of the owner within a specific floor of the building, and it is legal proof when constructing the complex with standards conforming to legal specifications.
  • Full title deed: It is the deed obtained by the owner of the property upon the complete completion of the construction or construction of the property, in which there is a full explanation of the location of the property.
  • Building deed: This type shows the specifications of the property in general, without mentioning the details and sections of the building, and this type is used when buying a separate property.
  • Land Bond: There are two types of agricultural land that are suitable for reconstruction by 10% of the total land area, while construction or residential allows construction on them within larger areas.
  • Musharaka bond: This type of bond is used for a certain period, and the owner of the property has the right during this period (sale - purchase - rent) the property.
  • Joint title deed: This type of title deed depends on the purchase of one property by several people and the registration of the property in the names of all of them, with an explanation of the share or percentage of ownership of each person, knowing that if one of the parties wishes to sell his share, he cannot without obtaining the consent of the other partners.
  • Commercial Register: This type of register is used on non-residential real estate, but of a commercial nature (shops, offices).

Notes to be paid attention to during registration for title deed:

When registering a property and carrying out title deed procedures, you must pay attention to several important points, in order to ensure the safety of the proper functioning of things and to ensure that all the necessary papers are present, the most important of which are:

  • The type of property must be mentioned in the title deed and clarify whether the ownership of the property is still an easement deed or has turned into a full title deed.
  • If the type of property is clearly mentioned, apartment, villa, shop, this indicates that the property has obtained the full title deed.
  • If the property information such as floor, area, and property number is mentioned, this means that the property is still an easement and has not been converted into full ownership.
  • It must be ensured that the necessary paper to secure earthquakes and natural disasters is extracted and combined with the required papers.
  • There must be receipts in which the real price of the property is written in Turkish lira in order to avoid financial taxes.
  • The real estate registry document to which the property belongs, is required.
  • You must pay the value of the title deed fee, and put the receipt with the papers.
